5. Your Tax Return Information: IRC Section 7216 Protections

Federal law — specifically Internal Revenue Code Section 7216 and Treasury Regulation § 301.7216-2 — prohibits tax return preparers from knowingly or recklessly disclosing or using any information furnished in connection with preparing a client’s tax return, except as specifically permitted by law. Violations of Section 7216 are criminal offenses.

We will not use or disclose your tax return information for any purpose other than preparing your return and providing directly related tax services, except in the following circumstances permitted by law:

  • To another officer, employee, or contractor directly involved in preparing your return, within the United States (§ 301.7216-2(d))

6. Professional Confidentiality Obligations

As a licensed Certified Public Accountant, we are subject to the AICPA Code of Professional Conduct and the Idaho State Board of Accountancy’s professional standards, both of which impose strict confidentiality obligations. We do not disclose client information except as permitted by professional standards, required by law, or expressly authorized by you.

We are also subject to the Gramm-Leach-Bliley Act (GLBA) Safeguards Rule, which requires financial institutions — including CPA firms — to implement and maintain a comprehensive information security program to protect the confidentiality and integrity of client nonpublic personal information (NPI). While licensed CPAs are exempt from certain GLBA annual privacy notice requirements under the Financial Services Regulatory Relief Act of 2006, we maintain data security practices consistent with the GLBA Safeguards Rule.
